GRAVEYARD OF HUMAN RIGHTS

Africa is a graveyard of human rights laws that seem to be quashed everyday. Rights abuses and impunity have had a totally zero redress. The protection of rights listed in the African Charter rested entirely on the African Commission with no judicial forum for enforcement. The ACPHR seems to be the missing link in the African Human rights mechanism and clearly shows how African States have been reluctant to realise it.
I stand to be corrected, but one of the function of the Court is to make African States Kenya included accountable for human rights violations in their jurisdiction. In essence, it gives the Court a wide remit but its unfortunate that only 23 States have ratified the ACHPR Protocol out of the possible 53 African Union Members. It therefore remains for the Court to be set up effectively to function independently and develop it's own jurisprudence. But with judges elected by Heads of States, we have a long way to go. With 2 of the 11 judges being female, there seems to be yet another snag in terms of issues relating to violations of human rights and this could be compromised.
I am not a lawyer or one that is in the legal fratanity but i know that ACHPR is an important step geared towards the protection of human rights in Africa, however due to poor governance and the likely cases of widespread illiteracy, this may just take a little longer to be achieved.
